When you submit a patent application number and select an office action, your analysis goes through several stages. Understanding this patent prosecution pipeline helps you know what to expect as patentreply.ai builds your office action response strategy.

Patent Analysis Pipeline

Your patent office action analysis progresses through these stages in order:

  1. Document Fetching — Retrieves the patent office action, patent application (specification and claims), and all cited prior art references from USPTO PAIR. This includes the full specification, patent claims, and any drawings.

  2. Document Parsing — Extracts and structures the key content: individual patent claims, specific examiner rejections, cited prior art sections, and relevant specification passages.

  3. Rejection Analysis — Analyzes each type of patent examiner rejection found in the office action:

    • §102 (Anticipation): Element-by-element comparison of patent claims with cited prior art
    • §103 (Obviousness): Analysis of the examiner's motivation to combine prior art references
    • §101 (Subject Matter Eligibility): Alice/Mayo framework analysis for patent eligibility
    • §112 (Disclosure): Written description, enablement, and definiteness issues
  4. Strategy Generation — Creates comprehensive office action response recommendations based on all the analyses, including specific patent claim amendment suggestions and argument strategies to overcome each rejection.

Monitoring Progress

While your patent analysis runs, you can monitor its progress:

  • The analysis card on your dashboard shows the current stage with a progress indicator
  • Each completed stage displays a checkmark
  • You'll receive a notification when the analysis is fully complete
  • Real-time updates mean you don't need to refresh the page

What You'll See When Complete

Once finished, your patent office action analysis includes:

  • Executive Summary — High-level overview of the patent examiner's rejections and recommended response approach
  • Strategy Document — Detailed office action response strategy with specific recommendations for each rejected patent claim
  • §102/§103/§101/§112 Analyses — In-depth analysis of each rejection type, including prior art mapping, obviousness arguments, and eligibility issues
  • Prior Art Analysis — Detailed comparison with each cited reference, showing how prior art elements map to your patent claim limitations
  • Patent Claims (Clean & Redline) — Current claims alongside suggested claim amendments with tracked changes

When NPL (Non-Patent Literature) Is Cited

If the examiner cites non-patent literature — such as journal articles, technical standards, or other publications not available from USPTO PAIR — the analysis pauses and waits for you to upload the cited documents.

What You'll See

  • The analysis card on your dashboard shows Action Required
  • When you open the strategy workspace, a yellow banner appears: NPL Upload Required Before Full Analysis
  • A provisional workspace is already available with the office action, claims, and any auto-retrieved prior art
  • The banner lists each missing NPL reference with an Upload PDF button

How to Upload NPL and Resume

  1. For each cited NPL reference listed in the banner, click Upload PDF and select the corresponding PDF file (e.g., from the journal or standard you cited)
  2. Wait for each upload status to show Ready (processing may take a moment)
  3. Uploaded NPL documents appear in the Prior Art section of the left sidebar once processed
  4. When all required NPL references are uploaded, click I Uploaded NPL -- Continue Analysis
  5. The full analysis (rejection analysis and strategy generation) runs using your uploaded documents

Proceeding Without NPL

If you cannot obtain a cited NPL document, you can choose Proceed Without NPL. The analysis will continue, but it may lack context for that reference. Use this option only when the NPL is unavailable or not critical to the rejection.

If an Analysis Fails

Occasionally a patent analysis may fail due to:

  • Unavailable documents on USPTO PAIR
  • Temporary network issues with the USPTO servers
  • Unusual document formatting that can't be parsed

If this happens, credits are automatically refunded to your account. You can retry the patent office action analysis immediately at no additional cost.
