The Patent Claim Amendment Workspace is a rich text editor designed for drafting patent claim amendments to overcome office action rejections. It features automatic track changes, AI-powered feedback on whether your amendments overcome the cited prior art, and export to Word (DOCX) format for filing with the USPTO.
Opening the Claim Editor
- Open Chat with Documents from the Workspace section in the sidebar
- Click the "Open Claim Editor" button in the chat header
- The editor appears on the left, with the chat panel on the right
- Select a patent claim from the dropdown at the top of the editor to begin
The claim editor loads the current patent claim text so you can start drafting amendments immediately.
Automatic Track Changes
The editor tracks your patent claim amendments in real-time, similar to Microsoft Word's Track Changes feature:
- New text — Appears blue and underlined as you type new claim limitations
- Deleted text — Appears red and struck through when you remove claim language
- Toggle tracking — Click "Track Changes ON/OFF" to enable or disable automatic tracking
When auto-tracking is turned off, you can still manually mark text using the toolbar:
- Select text and click Underline to mark it as an insertion
- Select text and click Strikethrough to mark it as a deletion
Pro Tip: Keep Track Changes ON while drafting patent claim amendments so you can easily see what changed at a glance, exactly as you would present claim amendments to the USPTO patent examiner.
Analyzing Your Patent Claim Amendments
Once you've drafted a claim amendment, click "Analyze Amendment" below the editor to receive AI feedback on whether it overcomes the rejection:
- Distinguishing Features — Does the patent claim amendment clearly distinguish over the cited prior art?
- Overcoming Rejections — Will this amendment overcome the §102 anticipation or §103 obviousness rejections in the office action?
- Specification Support — Is the amended claim language properly supported by the patent specification?
- Potential Issues — Any problems introduced (new matter, antecedent basis errors, unintended broadening of claim scope)?
- Recommendations — Specific suggestions for strengthening the patent claim amendment
The analysis appears in the chat panel on the right, with references to the patent office action, prior art, and specification.
Iterating on Claim Amendments
Use the AI feedback to refine your approach to overcoming the patent examiner's rejection:
- Review the analysis feedback in the chat panel
- Adjust your patent claim amendment in the editor
- Click "Analyze Amendment" again for fresh feedback
- Continue iterating until you're satisfied the amendment overcomes the rejection
Best Practice: Test multiple claim amendment approaches. The AI can help you evaluate different strategies — narrowing claim scope vs. adding new limitations vs. restructuring patent claims — before committing to one.
Asking Follow-Up Questions
After analyzing a patent claim amendment, continue the conversation in the chat panel:
- "Would adding 'real-time processing' make this claim amendment stronger against the prior art?"
- "Can I find specification support for this claim language in paragraphs [0045]–[0050]?"
- "How does this amendment approach compare to the approach for claim 5?"
You can also switch the chat context to specific patent documents while keeping your claim amendment visible in the editor.
Exporting Your Work
Click "Export" below the editor to download your work:
- Word (DOCX) format — Preserves track changes formatting for direct use in your office action response filed with the USPTO
- The export includes the amended patent claim text with all insertions and deletions marked
Auto-Save
Your patent claim amendments are automatically saved as you type:
- No manual save needed — changes persist across browser sessions
- Claims with amendments show (Amended) in the sidebar and dropdown menus
- A blue indicator appears next to amended patent claims in the Claims document
- Amendments are stored both locally and in the cloud for reliability
